ARTICLE 1. DEFINITIONS

  1. You” and “your” mean you, the user.
  2. ACADEMIQUIRK,” “we,” “us,” and “our” means ACADEMIQUIRK, a Roton Consultancies Private Limited. business, which is located at Melbourne, Australia.
  3. ACADEMIQUIRK Services” mean all services carried out by ACADEMIQUIRK for you.
  4. Documents” mean all documents provided to ACADEMIQUIRK by you, including, but not limited to, theses, papers, essays, documents, or reference lists.
  5. Order” means an agreement between you and ACADEMIQUIRK in which ACADEMIQUIRK agrees to provide specific ACADEMIQUIRK Services, including those for which fees are charged.
  6. Plagiarism Check” means a ACADEMIQUIRK Service provided in partnership with plagiarism checking tool that utilizes the plagiarism checking tool Database to check a Document for plagiarism.
  7. Proofreading & Editing Service” means a service provided by an Expert on ACADEMIQUIRK who proofreads and edits an uploaded Document.
  8. Citation Checker” means a ACADEMIQUIRK Service that entails a Document being checked for accurate citations.
  9. Citation Generator” means a ACADEMIQUIRK Service that generates citations from sources.
  10. Self-Plagiarism Checker” means a ACADEMIQUIRK Service that compares Documents with unpublished and private documents, checking for similarities.
  11. Proofreading & Editing Period” means the period that ends with the final time and date by which a Document should be checked.
  12. Expert” means a natural or legal person who is engaged by ACADEMIQUIRK to perform the ACADEMIQUIRK Services in an Order.
  13. plagiarism checking tool Database” means a third party database that is used to scan Documents for plagiarism.

ARTICLE 2. APPLICABILITY

  1. These Terms of Use form part of the binding agreement between you and ACADEMIQUIRK. They collectively govern your use of ACADEMIQUIRK Services and apply to any tender, offer, Order, or other related agreement between you and ACADEMIQUIRK.
  2. BY REGISTERING FOR AND/OR ACCESSING, BROWSING, USING, OR SUBSCRIBING TO THE ACADEMIQUIRK SERVICES, OR BY ACCEPTING AN OFFER, OR BY CLICKING “I AGREE” OR OTHERWISE AFFIRMATIVELY MANIFESTING YOUR INTENT TO AGREE AND BE BOUND BY THESE TERMS OF USE, YOU SIGNIFY THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF USE. IF YOU DO NOT AGREE TO THESE TERMS OF USE, YOU MAY NOT ACCESS OR USE THE ACADEMIQUIRK SERVICES.

ARTICLE 3. PRIVACY POLICY AND ADDITIONAL POLICIES

  1. The ACADEMIQUIRK terms of service are incorporated herein by reference and apply to your use of the ACADEMIQUIRK Services.
  2. You acknowledge that ACADEMIQUIRK may collect and use your personal information in order to provide the ACADEMIQUIRK Services. The privacy policy describes how we collect, process, use your information, and how to exercise your consumer privacy rights.

ARTICLE 4. THIRD PARTY SERVICE

  1. The ACADEMIQUIRK Services may contain links or connections to Third Party Services. We have no control over and assume no responsibility for the content, accuracy, terms and conditions, privacy policies, or practices of or opinions expressed by any Third Party Service that you interact with through the ACADEMIQUIRK Services. When you access or use a Third Party Service via ACADEMIQUIRK, you may be subject to the terms and conditions of such Third Party Service.

ARTICLE 5. OFFER

  1. An offer contains a complete and accurate description of the ACADEMIQUIRK Services being offered to you by ACADEMIQUIRK. The description will be detailed enough that you can properly assess it. Mistakes or obvious errors within the offer are not binding on ACADEMIQUIRK.
  2. To accept an offer, you may be required to create a User Account and/or provide us with accurate payment information. You must maintain the security of your User Account and immediately notify us if you discover or suspect that someone has accessed your User Account without your permission.

ARTICLE 6. ORDER

  1. The Order is concluded when you accept ACADEMIQUIRK offer.
  2. ACADEMIQUIRK will confirm receipt of your acceptance of the offer by electronic means.

ARTICLE 7. MODIFICATION OF THE ORDER

  1. If during the execution of the Order it is revealed that it is necessary to alter or supplement the Order in order to implement it properly, ACADEMIQUIRK will consult you, and you and ACADEMIQUIRK will agree to any modifications to the Order.
  2. ACADEMIQUIRK can refuse a request to modify an Order without being in default of the Order or omitting any information from it

ARTICLE 8. CANCELLATION OF AN ORDER BY ACADEMIQUIRK

  1. ACADEMIQUIRK has the right to cancel an Order after it has been concluded.
  2. ACADEMIQUIRK has the right to cancel an Order if ACADEMIQUIRK considers that the Document uploaded by you does not meet minimum requirements.
  3. The minimum requirements for a Document are as follows:
    1. The Document must be education related.
    2. For the Proofreading & Editing Service, the quality of the Document must be such that an Expert can check the Document in a standard manner. This assessment of quality is undertaken by ACADEMIQUIRK. When the basic quality of the Document is deemed to be too low, an Expert cannot edit the Document following the normal procedure.
    3. You must not appear to be committing fraud.
  4. All content, including Documents, uploaded on ACADEMIQUIRK must comply with our Copyright Policy. Violations of this policy will result in ACADEMIQUIRK canceling an Order.
  5. When ACADEMIQUIRK cancels an Order, we will contact you as soon as possible.

ARTICLE 9. LICENSE TO YOUR CONTENT

  1. By submitting content (including Documents) to ACADEMIQUIRK, you grant ACADEMIQUIRK a nonexclusive worldwide, royalty free, fully paid up, transferable, sublicensable (through multiple tiers of sublicensees, including ACADEMIQUIRK affiliates), license to translate, modify, store, edit, display, perform, reproduce, distribute, and otherwise use your content in connection with the operation, improvement or use of ACADEMIQUIRK Services, in any and all media or distribution methods (now known or later developed). The rights granted to ACADEMIQUIRK under this section are perpetual (subject to Article 10, Retention of Documents) and irrevocable, to the maximum extent permitted by law. For clarity, this license enables us to provide the ACADEMIQUIRK Services and is not intended to otherwise limit your ownership rights in your content. Moreover, we only share your Documents with Experts and third party vendors to enable us to operate the Services and do not share them with other users.

ARTICLE 10. RETENTION OF DOCUMENTS

  1. If you purchase a Proofreading & Editing Service, ACADEMIQUIRK will store your uploaded Documents on its server for up to one year.
  2. If you purchase a Plagiarism Check, you give ACADEMIQUIRK permission to save the Document in a protected and private plagiarism checking tool Database. This database is only accessible by ACADEMIQUIRK, and the documents it contains cannot be viewed by educational institutions.
    Documents in the protected database within plagiarism checking tool are subject to plagiarism checking tool data retention policies.
  3. If you purchase a Citation Checker or Self-Plagiarism Checker, ACADEMIQUIRK will store the Document on its server for up to 90 days.
  4. If you upload a Document on Citation Generator, ACADEMIQUIRK will store the Document on its server for up to 30 days.
  5. The nature of the Proofreading & Editing Service necessitates that the ACADEMIQUIRK Expert receive the Document being checked. Once the Expert has finished checking the Document, they are contractually obligated to delete it.

ARTICLE 11. REVIEW PERIOD FOR PROOFREADING & EDITING SERVICE

  1. The Proofreading & Editing Period will be determined when the Proofreading & Editing Service is purchased.
  2. The assigned Expert may decide when the Document is checked, so long as they deliver the checked Document before the deadline.
  3. ACADEMIQUIRK will communicate the Proofreading & Editing Period to you in advance via email. The Proofreading & Editing Period can also be viewed in the customer area on the website.
  4. The Proofreading & Editing Period shall begin at the time of payment and end when ACADEMIQUIRK returns the checked Document to you.
  5. If the Expert anticipates that they will not meet the deadline, ACADEMIQUIRK will inform you in a timely manner.
  6. ACADEMIQUIRK is not responsible for unforeseen technical problems that lead to you receiving the checked Document late.

ARTICLE 12. DEADLINES FOR PLAGIARISM CHECKS

  1. The time required to execute a Plagiarism Check depends on the level of activity at plagiarism checking tool, which ACADEMIQUIRK is unable to influence.
  2. You may only request a refund of the invoice amount for a Plagiarism Check if 24 hours have elapsed since the time of payment and the check has not been completed. You must request this refund before the results of the Plagiarism Check are communicated. You will then be notified by email when the results of the Plagiarism Check are received.
  3. Paragraph 2 of this Article is not applicable if ACADEMIQUIRK states on its website that Plagiarism Check services are currently taking more than 24 hours.
  4. Notwithstanding the foregoing, nothing in these Articles affect your rights as a consumer under applicable law, including, without limitation, your right of withdrawal for paid services.

ARTICLE 13. CANCELLATION INFORMATION

  1. You cannot cancel a Plagiarism Check.
  2. You cannot cancel a Citation Check.
  3. You cannot cancel a Self-Plagiarism Check.
  4. You cannot cancel an AI proofreader check.
  5. If you cancel an Order for a Proofreading & Editing Service, you are obligated to pay for any costs that ACADEMIQUIRK has reasonably incurred in connection with undertaking the Order.

ARTICLE 14. IMPROVEMENT OF ACADEMIQUIRK SERVICES

  1. ACADEMIQUIRK and its affiliates apply machine learning and AI techniques to Documents for the future improvement of our writing services. ACADEMIQUIRK will take commercially reasonable steps to remove personally identifable information from all Documents shared with afliates for this purpose.

ARTICLE 15. TAKE-DOWN REQUESTS & CLAIMS OF INFRINGEMENT

  1. ACADEMIQUIRK expressly prohibits users from uploading, posting, or otherwise distributing through ACADEMIQUIRK Services any content (including Documents) which may violate another party’s intellectual property rights, privacy, publicity, or other rights. If any user believes any content submitted through ACADEMIQUIRK Services violates or otherwise infringes upon any of the user’s rights, the user is encouraged to contact ACADEMIQUIRK immediately to request that the allegedly offending content be removed from the ACADEMIQUIRK Services.

ARTICLE 17. SURVIVAL

All provisions of these Terms of Use which by their nature should survive termination will survive
termination.

ARTICLE 18. ADDITIONAL INFORMATION

  1. When the interpretation of one or more provisions of these Terms of Use are unclear, an explanation “in the spirit” of these provisions shall apply. This also applies to situations that these Terms of Use do not detail.
  2. If ACADEMIQUIRK is not in strict compliance with these Terms of Use, it does not mean that these provisions are invalid or that ACADEMIQUIRK loses its right to otherwise demand strict adherence to them.
